yea chris byt he way earlier today I saw ne of the neighbors and they said they didn't see anything....we gatta find out if anyone else knows what happened.....someone had to have seen it I mean for one thing there was a freakin party across the street that night! Listen, about your car, I already talked to several lawyers and posted this same crap over at NASIOC.COM. Those tow truck drivers also jimmy cars to pull the ebrake so they can tow. THat act is completely illegal and they cannot do it. I caught SHAMROCK doing that in my lot here on campus, I have a ton of legal info for you, send me an email to chrismindless@lycos.com and I'll hook you up with my cell phone ... you can sue, you have to sue, and there is also MORE you can get out this other than your car fixed. Basically it goes like this:
Towing is business, a profession (yeah right). They adhere to the same business laws as EVERYONE else, they are liable in everyway. CHeck to see if your door was jimmyed ... are your locks working? Is anything missing from the car? That photo of the grass and pole, that will win your case, you have evidence and are going to win this easily.
You have to organize your case and get ready to put in their pooper. Was it a public space or private? THis is very important to know. If it was a public you can be sited for the parking HOWEVER if it is public you cannot be sited, only towed. BUT if your vehicle is damaged in the process, then the person at fault is not only the tow company but depending on the agreement between them and the owner, the owner of the lot can also be held accountable.
Now, yes they are accountable and yes you can sue and yes you can win and yes it sucks horribly ... the best part is, you find a shop that is willing to charge extra, to do the car right, also, now you want your whole car painted so that it matches up PERFECTLY, your suspension, is it perfect? NO? Then you need new suspension ... etc. THere is a cap as to how much you can sue for in damages in small claims, I think it is $3000 or $4000 , but im originally from cleveland, so you have to check that out when you file the papers in the court of the city in which this happened. Are they located in the same city as where you were towed?
You need this info in order to know which court house you go to. ALso, all court costs can be added to the claim, so you wont pay for anything in the end. Send me an email and call me up or give me a number. I hate these towing companies to hell, they destroyed my drivetrain once and if you have other plans, count me in for sure!

Good advice. Chris, he's right. If you show up to court unprepared and unorganized without proof you're screwed. Get every penny you can out of them. Did you ever call the news station like I told you?
